Non-Lucrative Visa Renewal Help

A non-lucrative residence authorisation is renewed in Spain. You apply to the immigration office during the two months before it expires. You show that:

  • you still have the means to live without working;
  • you've kept health insurance and will continue it;
  • any children of compulsory school age are in school;
  • you've lived in Spain for more than 183 days in the calendar year.

A renewed authorisation normally lasts two years.

The office also looks at any criminal convictions and at whether you've met your tax and Social Security obligations. It can take into account a regional report on integration.

Timing

  • Window: the two months before the expiry date. Filing in time keeps your authorisation valid until the decision.
  • Late: an application within three months after expiry also keeps it valid, but a penalty procedure can be opened.
  • Decision: within three months of filing. If there's no answer by then, the law treats the renewal as granted. That legal effect may need to be formally documented before you rely on it, for example to apply for your residence card or to travel, so ask your service how to evidence it.
  • Residence card: apply in person for the new TIE within a month of the decision being notified.

Your renewal, step by step

  1. Three to four months before expiry. Count your days in Spain this calendar year, check your insurance has run without a break, and gather evidence of your means for the next two years.
  2. Two months before expiry. The filing window opens. File early in it with the immigration office.
  3. On filing. Keep the receipt: filing in time keeps your authorisation valid until the decision.
  4. Within three months. The office decides. If there's no answer, the law treats the renewal as granted; ask your service how to document that before you rely on it.
  5. Within a month of the decision. Apply in person for your new TIE.

What renewal help usually covers

  • working out your window and the order of documents;
  • checking your means for the new period, including currency and statements;
  • reviewing your days in Spain against the 183-day condition;
  • checking the insurance evidence covers the period you've held the authorisation and the renewal period;
  • preparing and filing the application, and the TIE appointment afterwards.

Keep your insurance continuous

The regulation asks that you've held health insurance during the authorisation and continue it. A gap can therefore cause problems at renewal. Keep the policy running, and check that the certificate covers the renewal period. We help with renewals and plan changes so your existing cover isn't cancelled before the replacement is accepted. See renewing your visa insurance.

Common mistakes

  • Counting days loosely. The 183-day condition is about real and effective residence in the calendar year.
  • A gap in insurance. Continuity is part of the condition, not just cover on the filing date.
  • Waiting for the expiry date. File in the two months before it.
